Electronic Discovery

As part of our modern litigation practice in complex commercial litigation, PDR uses the most modern technology and stays abreast of developments in electronic discovery.  Those tools include software such as Concordance and Forensic Toolkit, and relationships with various experts around the country.  Traditional litigation focused on requests for paper based information.  In modern life, most information is exchanged, and stored, electronically.  Since 2006, U.S. federal courts have been leading the way with changes to various federal rules and complex and interesting cases relating to electronic discovery.  Having a good electronic information policy, including litigation holds and destruction protocols, is often key to defending a lawsuit.  Conversely, in numerous cases, the presence or absence, or destruction, of electronic information has and can have a key impact to the outcome of a case.  At PDR, we have been involved from the beginning in the education and adoption of technology and legal principles relating to storage and discovery of electronic information.  We have served as experts and consultants in various cases dealing with discovery of electronically stored information.  The rules and principles governing electronic discovery are developing and changing every day, and we are committed to maintaining our leadership in Colorado in this area to effectively serve our clients.
